NOTICE OF A PASSING OF A ZONING BY-LAW AMENDMENT
TAKE NOTICE that the Council of the Corporation of the Municipality of Greenstone passed By-Law 26-37 on July 13, 2026 pursuant to Section 34(18) of the Planning Act, R.S.O. 1990, c.P. 13.
AND TAKE NOTICE THAT the written and oral submissions received relating to this application have been received and considered by Council as part of the deliberations and final decision related to the approval of the application as amended, including matters raised in those submissions and identified within Report PPS 191-26.
THE PURPOSE AND EFFECT of By-Law 26-37 is to amend the Greenstone Zoning By-Law 23-77, as amended, as follows: The proposed site-specific Zoning By-Law Amendment Application would rezone the subject lands from General Commercial (C1) to Residential Medium Density Exception (R2-X) to permit two (2) single detached dwellings on the subject lands, which are existing, and to add site-specific provisions which reflect the existing building setbacks. File # ZBLA 2026-03.
The subject land to which the By-Law applies is legally described as Plan M108 Lot 147 & 148 PCL. The civic address is 517 Main Street, Geraldton, Ontario, such property being within the corporate boundaries of the Municipality of Greenstone, District of Thunder Bay.
A copy of the By-Law is available for viewing in the Office of the Clerk between 8:30 a.m. and 4:30 p.m. Monday to Friday. A key map is provided with this Notice showing the location of the lands affected.
IF YOU WISH TO APPEAL the decision of the Municipality of Greenstone to the Ontario Land Tribunal (OLT), in respect to this By-Law, you may do so within 20 days of the issuance of this Notice by filing a Notice of Appeal via the OLT e-file at https://olt.gov.on.ca/e-file-services/ by selecting Greenstone, (Municipality of) as the Approval Authority no later than 4:30 p.m. on August 5, 2026. The filing of an appeal after 4:30 p.m., in person or electronically, will be deemed to have been received the next business day. If the e-file portal is down, you can submit your appeal to the Clerk at: kristina.miousse@greenstone.ca.
WHO CAN FILE AN APPEAL
Only the applicant, the Minister, or an owner of land affected by the planning application, a specified person or a public body who made the oral or written submissions to Council of the Municipality of Greenstone prior to Council’s decision may appeal a decision of the Municipality of Greenstone to the Ontario Land Tribunal. No person or public body shall be added as a party to the hearing of the appeal unless, before the by-law was passed, the person or public body made oral submissions at a public meeting or written submissions to the Council of the Municipality of Greenstone or, in the opinion of the Ontario Land Tribunal, there are reasonable grounds to add the person or public body as a party.
The Notice of Appeal must:
1. Set out the reasons for the appeal;
2. Be accompanied by the fee prescribed under the Ontario Land Tribunal Act in the amount of $1,100.00 per application, payable by certified cheque or money order payable to the Minister of Finance. (An appellant may request a reduction of the filing fee to $400.00. The request for a reduction of the filing fee must be made at the time of filing the appeal.
